NIL FAQ

  • What is a name, image, likeness (NIL) activity?
    • Situations where a student-athlete requires permission to use his/her NIL. Should a student-athletes give permission, he/she would have the opportunity to earn compensation. For example, Tyrell Ford may have a student-athlete make an in-person appearance for two hours for $500 as a way to get people to come look at cars.
  • Is a student-athlete required to report NIL activity to the Compliance Office?
    • Yes. A student-athlete may not engage in NIL activities without disclosing required information to the Compliance Office.
    • Student-Athletes must complete a disclosure form in Opendorse/ARMS  7 days prior to receiving compensation.
  • Can a student athlete receive compensation for participating in an official team event (i.e. being paid for an autograph while at an official competition or practice)?
    • No. A student-athlete may not receive any “pay-for-play” compensation. This includes signing autographs at University athletic events for compensation.
  • May a student athlete miss class time, practices, tutoring, etc. for a NIL activity?
    • No.
  • May the NIL agreement take place in a University of Wyoming campus or athletics facility?
    • No. All use of university property must go through the appropriate approvals on campus (i.e. General Counsel, Athletics Administration). Entities wanting to use university facilities must follow the appropriate UW Policies and procedures.
  • Is the University of Wyoming permitted to arrange NIL opportunities for athletes?
    • No. The University Athletics Department may not directly be involved in facilitating NIL activities for student-athletes.
  • Does a student athlete have to report NIL activity on taxes?
    • Yes. This is considered income and is subject to all applicable state and federal income tax laws.
  • How does NIL impact a student-athletes financial aid?
    • NIL activities cannot impact a UW student-athlete’s athletics financial aid status. However, because NIL is considered income, it may affect a student-athlete’s need based financial aid.
  • Can a student athlete obtain an agent or marketing agreements to assist with NIL activities?
    • Yes. All activities between agent/representative and student-athlete must specifically relate to NIL activities and not be affiliated with any professional athletics opportunities.

  • What is the difference between NIL activities and extra-benefits per NCAA rules?
    • NIL activities must be completed by the student-athlete and serve as “legitimate forms of work.” Meaning, the student-athlete has to perform his/her activity in order to receive NIL compensation. Extra benefits as defined by NCAA rules are benefits/services that are provided to student-athletes because of his/her status as an athlete.
  • Is a student-athlete required to provide his/her compensation to University of Wyoming?
    • No.
  • Who should a student-athlete contact with questions regarding contracts for potential NIL activities?
    • Student-athletes are advised to secure external financial, tax, and/or legal advice for questions related to NIL considerations. These activities are beyond the scope and role of the UW Athletic Department Compliance Office.
    • International athletes should contact International and Student Scholars Office to ensure compliance with visa. Currently, international student-athletes are not permitted to engage in NIL activities based on federal law.
  • Are there things a student athlete may not endorse in relation to NIL activities?
    • Any agreement that conflicts with existing institution endorsements – Please contact UW Athletics Administration with questions
    • Inappropriate behavior as determined by the Athletic Director
    • Alcohol products or alcohol related establishment (bars, clubs, etc.)
    • Apparel that conflicts with team sponsorships (i.e. Nike or Under Armor)
    • Any gambling activities
    • Any Illegal substances or drug-related activities
    • Tobacco related products
    • Marijuana related products

  • Do NOT:
    • Receive compensation without performing legitimate work. This is considered an extra-benefit and is impermissible per NCAA rules.
    • Enter into a contract for services that is contingent upon your enrollment at the University of Wyoming.
    • Enter into a contract for services where you receive compensation based on performance.
