Product Licenses

One Wyoming

Manufacturers producing products bearing Wyoming's famous Bucking Horse & Rider trademark and UW marks, names and other identifying indicia are required to be licensed; regardless of whether they sell solely to university departments or to third party retailers. Please note, if approved for licensing, a formal license agreement is issued that requires (among other items) the payment of royalties, submission of product samples, and the routine submission of artwork.  

The Trademark Licensing Office works directly with Wyoming vendors (i.e., located in Wyoming) seeking use of University and State of Wyoming marks on commercial products. The Trademark Licensing Office also works directly with vendors who seek use of the Bucking Horse & Rider mark in a non-collegiate manner on commercial products. The direct licensing program is structured to allow scalability and to encourage growth of licensed product sales by containing both a Crafters and Standard license component. Additional details about each of these components can be found below and on the licensing application itself.   
  • Crafters Agreement (Formerly Known As Entrepreneurial Agreement): Wyoming Crafters will pay a $100.00 Licensing Fee to utilize University of Wyoming and State of Wyoming trademarks on products that are primarily made by an individual out of the home.  This license and fee covers a one year licensing term with a renewal date of June 30th and allows a Crafter to sell up to $1,500 of product on an annual basis utilizing our trademarks.  All new licenses will be placed on a June 30 renewal schedule.  Please note the Licensing Fee is $100.00 no matter what time of year the licensing application is received.  We do not accept or review applications in JANUARY OR FEBRUARY.  Applications received March - June will renew the following June 30th. 
  • Standard Agreement: All new Standard licensees may be subject to a $250.00 Royalty Advance to utilize University of Wyoming and State of Wyoming trademarks on products.  This Royalty Advance can be waived in the discretion of the Trademark Licensing Office and is good for the two year licensing term.  The Royalty Advance is treated as a credit to the licensee’s account – meaning, quarterly royalties will draw down the Royalty Advance until it has been fully utilized.  All new licenses will be placed on a June 30 renewal schedule.  Effective immediately, a new royalty rate of 11% will be in effect for all new licensees.   
The State of Wyoming licensing program is designed to allow scalability and to encourage growth of licensed product sales.  In that regard, we have two categories of product licenses: (1) Crafters License and (2) Standard License.

1.    Crafters License: This license is intended to provide Crafters the opportunity to use their creativity without infringing upon the State or University’s trademarks. It also provides Crafters the ability to test the market before entering into a broader license. This agreement is NOT intended for distributors or promotional companies. Key elements of this license are as follows:
  • Key Elements of the Crafters License
    • This license is ONLY for Wyoming Crafters.  We do not issue Crafter's licenses to those residing outside the State of Wyoming.
    • This license is intended to provide Crafters the opportunity to use their creativity without infringing upon the State or University’s trademarks.  It also provides Crafters the ability to test the market with their licensed products.  This agreement is NOT intended for distributors, wholesalers, or ASI companies.
    • Required placement of officially licensed hologram stickers on all products.Electronic submission of an image of a finished sample through the Wyoming Licensing Portal.
    • Required submittals of all proposed products and designs through the Wyoming Licensing Portal for approval before production.
    • Ability to utilize the Bucking Horse & Rider, Pistol Pete and other UW trademarks and word marks.
    • A one-time $25 nonrefundable application fee is required with submission of the application. 
    • Licenses are granted for one year and may be renewed at the discretion of the TLO.  A $100 licensing fee will be charged on an annual basis for gross sales up to $1,500. 
    • If a Crafter sells more than $1,500 in a given year, you will pay a royalty at 8.5% on gross sales greater than $1,500.  In addition, you may be asked to switch to a Standard Product License.
    • Insurance requirements are generally waived.*
    • Sales must be made direct to the consumer through an online site (personal website, Facebook, or Etsy) or to retailers.  The use of a distributor or agent is not permitted.
  • Licensing Steps
    Given our commitment to ensure that all licensed products positively reflect upon the State of Wyoming and the University of Wyoming, the following licensing steps must be followed:
    • Submit a completed licensing application by completing this form, saving, and emailing to trademrk@uwyo.edu.  Then pay the $25 nonrefundable application fee at the following link: Crafters License Application Fee
    • Along with the application, you must submit an image of a sample product currently produced by you or your company.
    • If your application is approved, a contract will be sent for your review and signature.  
    • At the time of the contract signature phase, we will also require payment of the $100 licensing fee.  Payment can be made by made online at the following link: Crafters Licensing Fee
    • Once a license agreement has been signed by both parties and payment of the licensing fee has been received, you will be given login authorization to the Wyoming Licensing Portal where you can access the UW and State of Wyoming trademarks.
    • Licensee must then submit a digital image of a product sample bearing the licensed marks to the TLO via the Wyoming Licensing Portal for review & approval before sale or distribution of products.
    • Sample designs or products must be submitted within 60 days of submission of the licensing application, or your application will be cancelled, and you will be required to restart the process. 
    • Once licensing is complete, you will be required to order stickers that must be placed on licensed products – the stickers come in 1/4” and 1” sizes.  Holographic stickers come in lots of 250 and are priced at $25 per 250 stickers up to 1000 and $100 for a roll of stickers (the small stickers come in rolls of 2000 and the large stickers in rolls of 1000).  Sticker orders and payments are made at the following link: Sticker Order
  • Insurance Requirements
    Licensees producing the following items will be required to secure commercial liability insurance and name the University of Wyoming as an additional insured:
    • Consumable items (food & beverage).
    • Goods marketed for use by children.
    • Any goods considered high risk. 
    • Liability requirements generally start at $1,000,000 for most products but may be increased at the discretion of the TLO.  Licensees required to carry commercial liability insurance must submit proof of insurance within 60 days from execution of the licensing agreement.    
2.    Standard License: A standard license agreement is intended for distributors, promotional companies, and those companies with anticipated annual licensed product sales surpassing $1,500. Key elements of this license are as follows:
  • Key Elements of the Standard License The standard product license is intended for distributors, Advertising Specialty Institute (ASI) suppliers, wholesalers, screen print and embroidery shops, and those other companies with anticipated annual licensed product sales surpassing $1,500.  Individuals or Crafters that make products out of the home and sell primarily on a personal website, Facebook, Etsy and craft fairs should consider the Crafters License.
    • This license is only for those prospective licensees that reside within the State of Wyoming.  We do not license out-of-state organizations through the Wyoming Trademark Licensing Office.  If you are out-of-state and wish to pursue a license to use State of Wyoming and University of Wyoming marks, please visit http://www.exemplarassociates.com/ for additional information. 
    • Required placement of an officially licensed sticker on retail products.
    • Electronic submission of an image of a finished sample of a product through the Wyoming Licensing Portal.
    • Required submittals of all proposed products and designs through the Wyoming Licensing Portal for approval before production.
    • Ability to utilize the Bucking Horse & Rider, Pistol Pete and other UW trademarks and word marks.
    • A one-time $25 nonrefundable application fee is required with submission of the application. 
    • Collection and submission of royalties at an 11% rate.
    • Royalty reports must be submitted via the Wyoming Licensing Portal on a quarterly basis.
    • Licenses are generally granted for two-year periods with the option to renew.  A $250 licensing advance is required at the beginning of each two-year licensing period.  As royalties are reported quarterly, the TLO will work off of the advance before additional payments are collected from the licensee. 
    • Licensees pay 11.5% on the wholesale price of products.  For this purpose, wholesale price is defined as 50% of the retail price of the product. 
    • Product Liability Insurance requirement is generally waived.*
    • Sales must be made direct to the consumer or retailer.  The use of a distributor or agent is not permitted.
