Organizational Use License

One Wyoming


The Bucking Horse & Rider Organizational Use Agreement is intended for those Wyoming organizations, businesses, or political subdivisions seeking to use the Bucking Horse & Rider mark in advertising, marketing or promotion by use of the BH&R in signage, on a website, social media, letterhead, promotional materials or similar business-related uses.  If the application is approved, a formal license agreement will be issued. These agreements are granted to further the interests of the state of Wyoming through the promotion of Wyoming business, tourism and products and services originating in Wyoming.  The agreement runs for a term of two years with the option to renew. 

Effective July 1, 2022, all new Organizational Use licensees will pay a $250.00 Licensing Fee to use the famous Bucking Horse & Rider (BH&R).  The Licensing Fee covers a two-year licensing term with a renewal date of June 30.  All existing Organizational Use Agreements will be subject to the new $250.00 Licensing Fee when contracts renew – starting with contracts that are up for renewal June 30, 2022.  All new applicants will pay $250.00 no matter when the application is received during the calendar year.   The Trademark Licensing Office will not receive or review applications in January or February of a given year.  
 

Getting Started
1.    Submit a completed licensing application by completing this form, saving, and emailing to trademrk@uwyo.edu.  Then Pay the $25 nonrefundable application fee at the following link:   Application Fee
2.    If the application is approved, the TLO will provide your organization with a BH&R Organizational Use Agreement for review and signature.  At the time of review and signature of the licensing agreement, you will also be required to pay a $250 license fee by check or online at the following link:  Organizational Use Licensing FeeThis licensing fee is good for two years and will be due and payable when the license is renewed.
3.    Once a licensing agreement has been signed by both parties and payment of the $250 licensing fee has been received, you will be given login authorization to the Wyoming Licensing Portal where you can access the BH&R mark.
4.    Organization must then submit for approval via the Wyoming Licensing Portal a digital image showing its intended use of BH&R mark. 
 
General Requirements for BH&R Organizational Use Agreement
  • Use of the BH&R mark under a BH&R Organizational Use Agreement is limited to use by organizations that have a physical presence in the state of Wyoming and conduct business in, or provide services that originate in, Wyoming.
  • The BH&R mark may only be used in the advertising of the organization’s business conducted in the state of Wyoming and for services originating in the state of Wyoming.
  • The manner and style in which the BH&R mark is used by an organization shall be consistent and approved by the TLO prior to use.
Permitted Uses of the BH&R Mark
  • Each organization is unique and its desired use of the BH&R mark can vary from integration in its logo and corresponding office materials to a myriad of other items that are used during its normal operations.  Those items where the BH&R mark is most commonly used and approved include: signage, letterhead, vehicle decals, websites, advertising & promotional materials and newsletters.
  • Use by the State of Wyoming and State Agencies: The University of Wyoming, the State of Wyoming, and Wyoming State Agencies may use the BH&R mark without a licensing agreement.
  • Use by Cities, Counties and Municipalities in Wyoming: Cities, counties and municipalities in the State of Wyoming will not be required to pay a licensing fee or have a licensing agreement on file with the TLO in order to use the BH&R mark.  At the current time, these types of organizations should contact the TLO about the process to connect with the State of Wyoming to obtain access to and permission to use the BH&R mark.
Advertising & Promotional Products
  • All uses of the BH&R mark are subject to review and approval by the TLO.
  • The BH&R mark may not be used on or in connection with any goods that are intended to be sold, offered for sale, sold or otherwise distributed in any type of commerce in exchange for any form of consideration.  Such use would require a separate product licensing agreement.
  • If use of the BH&R mark on apparel, headwear, drinkware and other items that are reasonably known to involve screen printing or embroidery, or similar application methods, is approved by the TLO pursuant to a BH&R Organizational Use Agreement, such items obtained by the organization must be acquired from an authorized product licensee and subject to applicable royalties.
  • Use of the BH&R mark on debit or credit cards may require a separate licensing agreement and applicants are encouraged to contact the TLO directly to discuss this issue.
Non-Permitted Uses of the BHR Mark
  • The BH&R mark may not be used in a manner that the State or University of Wyoming believes, in its sole discretion, disparages any of its components or agencies, or the citizens of Wyoming.
  • The BH&R mark may not be used in political campaigns or on campaign materials, social media or websites.
  • The BH&R mark may not be altered in any fashion and should be utilized in the form provided to the licensee and fully intact (e.g., do not change the rider, do not alter what the rider is holding in his hand, and do not put the rider on anything other than the approved horse).
  • The BH&R mark may not be used in a manner that creates confusion with any service provided by the State or the University of Wyoming.
  • The BH&R mark may not be used to imply association, partnership or endorsement of a product or service by the State or University of Wyoming.  In general, this also means that the BH&R mark may not be used by the business or organization in the official colors of the University of Wyoming (i.e., Brown & Gold).
  • The BH&R mark may not be used by colleges or post-secondary educational and academic institutions (for profit or state funded) other than the University of Wyoming.
  • The BH&R mark may not be included in any State or Federal trademark or service mark application or registration by the business or organization
